I-9s and E-Verify
Employment eligibility verification and I-9 compliance are required for every employer doing business in the United States. E-Verify is a voluntary program run by U.S. Citizenship and Immigration Services
(USCIS) that provides employers with electronic verification of employment authorization of newly hired employees to work in the United States. We will discuss I-9 compliance and best practices for completing an I-9 and the E-Verify process properly.

From SOC Codes to Prevailing Wage Levels, Processing Times, Start Dates, Six-Year Limits, and End-Client Letters, we will review H-1B trends to help petitioners avoid common pitfalls.

Amendments, New Petitions, Transfers, and Extensions
Amendments are required for any material change in the terms and conditions of an H-1B worker’s employment, but what exactly is a material change? When can an H-1B employee be moved to a new location?
What is the 240-day rule and when does it apply? We will discuss common questions that arise in the context of third-party placements and the employment of H-1B workers.
AFTERNOON PROGRAM 1 (1:00-2:30 PM)
Compliance with LCA Regulations
Scrutiny is expected to continue in the form of audits from the Wage and Hour Division (WHD). Understand what must be included in the Public Access File, compliance with the notification requirements, terminations and return transportation, what triggers a WHD investigation, additional requirements for H-1B Dependent Employers, Exempt employees, and maintaining the documents in an efficient, effective way.

Preparing for Site Visits
The Fraud Detection and National Security Directorate (FDNS) recently announced more targeted site visits for petitions involving third party placement and H-1B dependent employers. When site visits reveal discrepancies, they can result in revocation of an approved H-1B petition. We will discuss steps your company should take to set the stage for successful site visits.

Arm Your Employees for Successful Visa Interviews and Admission at Ports of Entry
An approved H-1B petition does not guarantee that a visa will be issued by a U.S. consulate or that a port of entry will allow admission into the country. H-1B holders attending visa interviews or traveling should be prepared with the proper documents and know what to expect during the interview and admissions process to avoid potential visa refusal or expedited removal. Learn what facts pose a high risk for triggering Administrative Processing and how to help employees prepare for encounters with CBP and consular officers.
