As of April 1st 2013, the H-1B filing window will open for individuals who have not held an H-1B previously (i.e. cap-subject petitions). There are only approximately 85,000 available.
Last year, the filing window was only available for 71 days, and the trend over the past three years indicates that this year could run out very quickly:
- FY 2011 Filing window open April 1, 2010 January 26, 2011 (300 days)
- FY 2012 Filing window open April 1, 2011 to November 22, 2011 (235 days)
- FY 2013 Filing window open April 1, 2012 to June 11, 2012 (71 days)
Based on our practice experience, we predict that the quota will fill up within the first 5 days. Due to the accelerated pace of quota filings that we are expecting this year, we suggest forwarding your cases to us once there is a known end-client project location. Please avoid the rush at the end of March and update us right away with the details of any H-1B cap-subject petitions you would like to file this year.
