Lawsuit against Arizona Governor for denying Driver’s License to DACA beneficiaries
Following the executive order issued by Arizona Governor Jan Brewer that denies driver’s licences to some young illegal immigrants who availed the immigration relief and work permits under The Deferred Action for Childhood Arrivals (DACA) program established by Obama administration, a lawsuit has been filed against the same.
It was filed by a group of various civil and immigrant rights organizations challenging the order on legal fronts, asking a federal judge to declare the policy as unconstitutional, for it fails to deliver a valid justification and the authority to decide who is illegal in the country rests with the federal government.
The DACA program that was announced in June was a major step taken in the direction of immigration reform, for it shielded the young illegal immigrants, younger than age 30 and who came to the United States before age 16 and have been in the country for at least five continuous years, from deportation, provided they are in school or GED program, or have served in the military.
Further, U. S. Department of Homeland Security had let the individual states decide on whether the benefits like driver’s license and extended ones such as in-state tuition to be granted to such immigrants. The decision to not grant driver’s license or other such benefits for deferred action immigrants was justified by saying that they aren’t in the country legally as President Obama’s executive orders does not grant the youths any status of being a legal citizen, thereby not entitling them to extended benefits.
The young immigrants on the other hand face major obstacles in their day-to-day life for the daily commuting is not possible without the license thereby causing delays in reaching important places and crucial meetings, and failing to provide Arizonian identification at necessary places such as rented apartments. The filed lawsuit is very important for young immigrants who have sought deferred action reliefs, and only the outcome will decide if their future in the state will be obstacle-free.
