I do not have my Birth certificate; what do I do to file Adjustment of Status (485)?

When you are filing for Adjustment of Status (also called as 485 applications) you need your Birth Certificate from the place of your birth.

When the birth certificate is not available we would require the following documents:

1. Non-Availability of birth certificate. (Sample 1)

2. Birth Affidavits from 2 different people at least 10-15 years older than the applicant, could be from uncle/aunt/relatives/family friends. (Sample 2) (Do not get birth affidavit from the parents)

It is better that you collect the following documents and keep it with you in case there is a request for additional documents from U. S. Citizenship and Immigration Services (USCIS).

1. Ration Card.

2. Pan Card.

3. School Records.

4. Government Records.

5. Medical Records.

6. Census Records.

7. Adhaar Card

8. Any other documents that shows the name and date of birth.

 

When the marriage certificate is not available we would require the following documents:
Marriage Affidavits from 2 different people, who have personal knowledge about the marriage, could be from relatives/family friends. (Sample 3)
