At present, the allocated EB-5 program visas are up-to-date, and although circumstances may evolve, it is anticipated that they will continue to be current until the summer of 2024. Considering the projected surge in demand for the EB-5 program in the future, there is a possibility of retrogression in priority dates. Hence, the optimal time to initiate the filing process is NOW.

Optimizing EB-5 Filing 

In light of recent adjustments to the EB-5 program, the current visa bulletin, and USCIS policy, individuals filing under the set-aside categories (high unemployment areas, rural areas, and infrastructure projects) can now submit their EB-5 I-526 concurrently with an I-485.

Opting for concurrent filing presents several advantages, including:

  1. Establishing your EB-5 priority date and safeguarding against potential retrogression in the future.
  2. Freezing the ages of children to prevent aging out.
  3. Applying for travel authorization (advance parole).
  4. Applying for work authorization (EAD).
