In light of recent adjustments to the EB-5 program, the current visa bulletin, and USCIS policy, individuals filing under the set-aside categories (high unemployment areas, rural areas, and infrastructure projects) can now submit their EB-5 I-526 concurrently with an I-485.
Opting for concurrent filing presents several advantages, including:
- Establishing your EB-5 priority date and safeguarding against potential retrogression in the future.
- Freezing the ages of children to prevent aging out.
- Applying for travel authorization (advance parole).
- Applying for work authorization (EAD).
