USCIS Resumes Premium Processing for I-129 and I-140 Petitions in Phases

USCIS announced today that it will resume premium processing for Form I-129 and Form I-140 in phases over the next month:

June 1st – USCIS will accept premium processing for all Form I-140 petitions.

June 8th – USCIS will accept premium processing upgrades for pending H-1B petitions filed before June 8th and are cap-exempt. This includes extension, amendment, and transfer petitions. Additionally, all other I-129’s, including L-1 and TN petitions, can be upgraded.

June 15th – USCIS will resume premium processing for H-1B petitions from a cap-exempt employer (institutions of higher education, nonprofit research organization, or a governmental research organization) or because the Beneficiary will be employed at a qualifying cap-exempt institution or the beneficiary is cap-exempt based on a Conrad/IGA waiver.

June 22nd – USCIS will resume premium processing for all cap-subject H-1B petitions (meaning you can upgrade a previously filed petition, or file concurrently with the H-1B cap petition). USCIS will also resume premium processing for all other I-129 petitions.

USCIS also noted that these dates are subject to change as USCIS continues to take on more premium processing requests and any changes to these dates will be announced accordingly.
